Wrongful Death

The loss of a loved one is a horrible experience under any circumstances.  When that loss is caused by the wrongful act or negligence of another, the law provides that the estate and survivors can sue to recover money damages.  There are two types of action available to the survivors and estate: an action for the Wrongful Death of the loved one, and an action for the suffering of the loved one, called a Survival Action.

Make no mistake, wrongful death and survival actions are not “simple” or “easy” no matter how straightforward the underlying case may be.  You can’t just settle these, even if the other side offers everything they have.  Every single case of this type requires courtroom work.  There are complicated rules about the taxation of the proceeds of these cases.  Once you are done with Uncle Sam’s wanting a share of the proceeds, then you have to get into the respective share of the proceeds that each survivor is entitled to, the effects of alienation, divorce, and separation on surviving spouse’s share, the shares of adopted children, of minor children, and so on.
